Welcome to Zush. These Terms of Service ("Terms") govern your use of the Zush application for macOS ("Service"), provided by Kirill Isachenko ("we," "us," or "our"). By downloading, installing, or using Zush, you agree to be bound by these Terms.

1. Description of Service

Zush is a macOS utility designed to help users organize, rename, and manage metadata for files using artificial intelligence (AI). Features include automatic renaming for images, PDFs, and supported documents, smart metadata tagging (Finder tags and Spotlight metadata), folder monitoring, and optional custom AI prompt controls for rename and tagging behavior.

2. Software License

We grant you a personal, non-exclusive, non-transferable, limited license to use Zush on macOS devices that you own or control, subject to these Terms.

3. Purchases and Payments

3.1 🌟 PRO Version Zush offers a "🌟 PRO" upgrade that provides credit-based access to AI renames, monitoring of multiple folders, and advanced metadata features. One credit equals one rename. Current pricing is displayed in the app and on the website.

3.2 Pricing Plans We offer a one-time purchase model:

  • Zush Free: 50 credits included. One credit equals one rename.
  • Zush PRO: One-time purchase of $10. Includes 10,000 credits and access to BYOK (Bring Your Own Key) for unlimited processing.

Credits are one-time and do not reset. Once credits are exhausted, PRO users can enable BYOK to continue using their own API key for unlimited processing.

3.3 Usage Limits Both free and PRO versions have usage limits for AI-powered features. Current limits are displayed in the application. PRO users who exhaust their credits can use BYOK for unlimited processing.

3.5 Merchant of Record Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

3.6 Refunds Refund requests are handled by Paddle in accordance with their refund policy.

4. AI-Powered Features and Accuracy

Zush uses artificial intelligence to analyze files and generate suggestions for names and metadata.

  • User Responsibility: Since AI can occasionally produce incorrect or unexpected results, you are responsible for reviewing and verifying any changes made by the Service to your files.
  • User-Provided Instructions: If you enter custom rename prompts, tagging prompts, or other prompt customization text, you authorize Zush to send that text through its backend and to the relevant AI provider as part of the analysis request. Do not include sensitive personal information unless you want it processed for that purpose.
  • No Warranty: We do not guarantee the absolute accuracy, completeness, or reliability of any information generated by the AI features.

5. Usage Limits and Fair Use

The free version of Zush includes usage limits (e.g., a limited number of AI-processed files). We reserve the right to monitor usage and suspend accounts that attempt to bypass these limits or engage in abusive behavior.

6. Intellectual Property

All rights, title, and interest in and to Zush (excluding user-provided content) are and will remain the exclusive property of Kirill Isachenko. "Zush" and its associated logos are trademarks of Kirill Isachenko.

7. User Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the application.
  • Use the Service for any illegal purpose.
  • Attempt to gain unauthorized access to our backend services or licensing systems.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIRILL ISACHENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA (INCLUDING FILE LOSS OR CORRUPTION), ARISING OUT OF YOUR USE OF THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, Phuket, without regard to its conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last updated" date at the top of this document or through an in-app notification.
