Terms of Service

Welcome to Zush. These Terms of Service ("Terms") govern your use of the Zush application for macOS and Windows ("Service"), provided by Kirill Isachenko ("we," "us," or "our"). By downloading, installing, or using Zush, you agree to be bound by these Terms.

1. Description of Service

Zush is a desktop utility for macOS and Windows designed to help users organize, rename, and manage metadata for files using artificial intelligence (AI). Features include automatic renaming for images, design files, audio, videos, and supported documents, including PDFs and iWork files, reusable templates, 145+ Naming Blocks for consistent filename structures, smart metadata tagging (Finder tags on macOS, file properties on Windows, and Spotlight metadata), folder monitoring with file-type exclusions, optional custom AI prompt controls for rename and tagging behavior, Finder context-menu renaming on macOS, BYOK cloud processing, and Offline AI mode with private local models via Ollama.

2. Software License

We grant you a personal, non-exclusive, non-transferable, limited license to use Zush on macOS or Windows devices that you own or control, subject to these Terms.

3. Purchases and Payments

3.1 🌟 PRO Version Zush offers a "🌟 PRO" upgrade that unlocks unlimited AI renames, reusable templates, Naming Blocks, custom AI prompts, monitoring of multiple folders, BYOK, Offline AI mode, and advanced metadata features. Current pricing is displayed in the app and on the website.

3.2 Pricing Plans We offer free usage plus two paid PRO plans:

• Zush Free: 50 credits included. One credit equals one rename.
• Zush PRO Monthly: $8/month. Includes unlimited PRO renames, reusable templates, Naming Blocks, BYOK (Bring Your Own Key), and Offline AI mode with private local models via Ollama.
• Zush PRO One-Time: $38. Includes lifetime access to unlimited PRO renames, reusable templates, Naming Blocks, BYOK, and Offline AI mode.

3.3 Usage Limits The free version has usage limits for AI-powered cloud features. Paid PRO plans remove the cloud rename limit. We may still apply reasonable abuse prevention and technical safeguards to protect service reliability.

3.5 Merchant of Record Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Purchases made through the Mac App Store or Microsoft Store are processed by the applicable store platform under its own payment, refund, and account terms.

3.6 Refunds Refund requests are handled by Paddle in accordance with their refund policy.

4. AI-Powered Features and Accuracy

Zush uses artificial intelligence to analyze files and generate suggestions for names and metadata.

• User Responsibility: Since AI can occasionally produce incorrect or unexpected results, you are responsible for reviewing and verifying any changes made by the Service to your files.
• User-Provided Instructions: If you enter custom rename prompts, tagging prompts, or other prompt customization text, those instructions are processed with the analysis request. In Cloud or BYOK modes, this means sending them through Zush backend infrastructure to the relevant AI provider. In Offline AI mode, they are processed by your local model.
• Local AI: If you enable Offline AI mode, you are responsible for installing, running, updating, and choosing your local Ollama models. Local model quality, speed, storage use, and availability depend on your device and your Ollama installation.
• No Warranty: We do not guarantee the absolute accuracy, completeness, or reliability of any information generated by the AI features.

5. Usage Limits and Fair Use

The free version of Zush includes usage limits (e.g., a limited number of AI-processed files). We reserve the right to monitor usage and suspend accounts that attempt to bypass these limits or engage in abusive behavior.

6. Intellectual Property

All rights, title, and interest in and to Zush (excluding user-provided content) are and will remain the exclusive property of Kirill Isachenko. "Zush" and its associated logos are trademarks of Kirill Isachenko.

7. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the application.
• Use the Service for any illegal purpose.
• Attempt to gain unauthorized access to our backend services or licensing systems.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIRILL ISACHENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA (INCLUDING FILE LOSS OR CORRUPTION), ARISING OUT OF YOUR USE OF THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, Phuket, without regard to its conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last updated" date at the top of this document or through an in-app notification.
